General

Your use of this website, and the Taste Beyond Online (i.e. the purchase by you of products and services from Beyond Compare Limited ), is governed by these Terms of Use. Further, all information submitted to or received through this website will be treated in accordance with these Terms of Use. By using this website, and submitting any online order, you signify your consent to these Terms of Use.
This website is directed solely at persons accessing the website from the Special Administrative Region of Hong Kong.

Eligibility and Registration

You must be aged twelve (12) years or older to use our Taste Beyond Online. If you are between the age of 12 and 18 years old or not capable of assuming legal responsibility, you should seek advice from your parents or guardians as to the meaning and consequences of these Terms of Use before using any of the services offered by Beyond Compare Limited. By registering for this service, you represent and warrant that you are aged 12 years or older and that you have the capacity to understand, agree to and comply with these Terms of Use. You should provide true, accurate and complete registration information. As part of the registration process, you will be asked to select a password and you will be responsible for all activities occurring under your login name (your email address) and for keeping your password secure.
You shall be responsible for updating your registration information.
Beyond Compare Limited has the absolute discretion to refuse the registration of a potential customer, or to terminate the registration of any customer, for any reason whatsoever.

Online Order

You will be liable for every order made under your login name and agree to indemnify Beyond Compare Limited for all claims arising from the actions of a person submitting an order using your login name (including the unauthorised use of your email address by a third party).
Beyond Compare Limited reserves the right to decline any order it may, in its opinion, consider unreliable having checked the user's history or the payment details submitted for that particular order.

Menu valid for delivery and takeaway only. Beyond Compare Limited shall make every effort to ensure that the prices, details and sizes of products contained in the website are correct but Beyond Compare Limited reserves the right to vary the price and other product details without notice.

Halal meal or veganism is not served in Beyond Compare Limited. Items supplied in Beyond Compare Limited where crustacean, egg, fish, peanut, milk and nut products are also provided. Beyond Compare Limited reserves the right of final determination over utilization of offers.
Beyond Compare Limited is unable to guarantee that any item sold or supplied is free from ingredients derived from animals, nuts or other allergens. There is always a risk that such ingredients, or traces of them, may be transferred to items during processing, storage or preparation. Although Beyond Compare Limited makes every effort to satisfy the special dietary requirements of its customers, it is unable to guarantee that such requirements can be met.

Deliveries

We shall use our best efforts to fulfill orders submitted through the Taste Beyond Online, but Beyond Compare Limited shall not be liable to any person if Beyond Compare Limited shall decline to fulfill an order for whatever reason, or if Beyond Compare Limited is unable to supply some or all of an order because of an unforeseen change to the products or because a product or an ingredient is unavailable.
Beyond Compare Limited will only affect deliveries to addresses in designated areas as the website may specify from time to time. Additional charges may be levied on deliveries to addresses located (refer to the website for further details). Beyond Compare Limited makes no representation that deliveries to all locations with the Special Administrative Region of Hong Kong are available.
Delivery will be suspended when a black rainstorm or typhoon signal No.8 or higher is hoisted.
All orders shall be deemed completed once the order has been delivered and duly paid for.

Payment

Payment for products ordered through the Taste Beyond Online can be made by Online Payment (see below). Beyond Compare Limited may change at any time the method by which payments for online orders may be made and a notice to this effect will be placed on the website.
You must ensure that a person aged 12 years or older is present at the time of delivery at your address to receive. If no such person is present, Beyond Compare Limited shall attempt to make the delivery at another time but reserves the right to charge an extra delivery fee.

Variation/Cancellation of order

Customer cannot amend and/or cancel order once the order is successfully placed and the payment is successful.
Order will be refunded if the purchased item is not available for sale.

Refunds of the price

The customer will be requested to send the photo to Beyond Compare Limited for record. The request for refund will not be processed unless we receive the photo for record.
The product will not be accepted for refund when it has been eaten, failure to meet personal preferences after use by customers, free-of-charge or giveaway items, discounted, clearance or special offer items with indication of being non-returnable, and the products purchased at Taste Beyond retail store.
Pictures of the products on the site may not exactly correspond to the actual description of the products. In such case, the written description of the product should be relied upon by the customer, and the customer shall not be entitled to refund the product on the basis that it does not exactly correspond to its picture posted on the site.
Upon verification is made by Beyond Compare Limited, we will refund the price of the product paid by you to the credit card/e-wallet account you have used to purchase that product.
The price paid by you via credit card/e-wallet will only be refunded to the same credit card/e-wallet account, and no cash refund is allowed.

Use of the website

You agree to abide by all applicable laws and regulations and are solely responsible for all acts or omissions by you, including the content of your transmissions through the Taste Beyond Online. By way of example, and not as a limitation, you agree not to:

Create a false or misleading identity of a user of the Taste Beyond Online.
Interfere with another user's use and enjoyment of the Taste Beyond Online.
Use the Taste Beyond Online in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website or our services.
Attempt to gain unauthorized access to the Taste Beyond Online or other accounts, computer systems or networks connected to that service.
Collect email addresses, passwords or other contact information of other users of the Taste Beyond Online, by electronic or other means.
Transmit, email or post any material that contains software viruses or such programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
Reformat or frame any portion of the web pages that are part of the website.

Use of Mobile Ordering

Beyond Compare Limited will not be responsible for any expenses incurred by you in browsing the mobile ordering service, which may include, but is not limited to, a data usage fee levied by your mobile service provider.

Please refer to our Privacy Policy (which forms part of these Terms of Use) to see what information we may collect from you and how we use that information.
Order details and personal information used in the course of this purchase will be treated confidentially.

Intellectual Property Rights

This website and any information available on it, including text, graphics, icons, images and trademarks, are protected by copyright, trade mark and other intellectual property rights owned or controlled by Beyond Compare Limited or by third parties. You may not copy, reproduce, upload, download, transmit, store in retrieval system, modify, alter or display in public or distribute in any way the contents or any part of this site for any purpose without our prior written permission.
All concepts and systems relating to the Taste Beyond Online shall at all times remain the property of Beyond Compare Limited.

In no event shall Beyond Compare Limited be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond its reasonable control including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, shortages of labour or materials, fires, floods, storms, explosions, acts of God or delays or non-performance by third parties.
No agent or representative of Beyond Compare Limited is authorised to make any warranties, representations or statements regarding the products or the Taste Beyond Online and Beyond Compare Limited shall not in any way be bound by any such unauthorised warranties, representations or statements.
To the extent permitted by law, Beyond Compare Limited shall not be liable for any direct, indirect, special, incidental, or consequential damages (including damages for loss of revenue, profits or data) arising in contract, tort or otherwise (including negligence) out of any use of, or inability to use, this website (including the Online Payment system).
Specifically relating to the Online Payment system, to the extent permitted by law, Beyond Compare Limited will not be liable for any loss or damage (including indirect and consequential loss) suffered by you by reason of (i) any failure, delay, interruption, suspension or any other restriction affecting your Online Payment; (ii) any errors, malfunctions or breakdown of your bank’s payment mechanism; or (iii) any other matter arising out of, or in connection with, the Taste Beyond Online.
In any event Beyond Compare Limited shall not be liable to you for any amount exceeding the price of the products ordered under the Taste Beyond Online which are the subject matter of any liability.

We reserve the right to change the information, services and resources available on this website, and these Terms of Use, at any time. These Terms of Use will be governed by and construed in accordance with the laws of Hong Kong, and the parties agree to submit to the exclusive jurisdiction of the courts of Hong Kong. If for any reason a court finds any provision or portion of the Terms of Use to be unenforceable, the remainder of the Terms of Use will continue in full force and effect. Any waiver of any provision of these Terms of Use by a party will be effective only if in writing and signed by a party. The applicability of these Terms of Use shall survive any termination of your registration for the Taste Beyond Online.
